When attempting to save or publish a new Workflow, the following error might occur:
Nintex.Workflow.WorkflowRepository.NameInUse
The full error in the ULS logs will include:
Nintex.Workflow.WorkflowRepository.NameInUse(String workflowName, Guid listId, WorkflowType& workflowType)
Instructions
Find and delete any empty folders from the Nintex Workflows hidden library. The library can be found at:
http://<Farm>/<Site>/NintexWorkflows
Once the empty folder is located and deleted the Workflow should publish correctly.

This is caused by an empty folder in the hidden Nintex Workflows library in the site.
