Minimum Attachments Validation Not Working Always

Very strange inconsistency, as out of 500+ items, only 2 have been submitted without an attachment.  I have the attachment control set with a minimum attachment of 1.  I cannot replicate it.  Every time I attempt to submit the form without an attachment, whether it's a new form or one that had already been submitted without an attachment, I receive the appropriate error message.  Any ideas how people could bypass this? Browser settings maybe?

I don't think this is an error per say as the form would have errored out if the attachment failed in some way. It could have been the wrong file type or a host of things to cause it to fail on the attachment but still upload the new item.  But if you're chasing down 2 out of 500+, hmm... Is it a business critical thing?
