Dynamically Populating Dropdown throws error while submitting form

I am dynamically populating the drop-down thru jQuery. It is populated in the same fashion as if it is coming from the 'Choices' of which has been set in the form.

i.e. 'data-nfchoicevalue' is populated, An 'Empty Node' is been populated along with the <Option>.

But when saving the form, the form gives the below error.

Any help would be highly appreciated.
