Document Set with Multiple Documents within the Doc Set

We do not want multiple emails going out to the approvers during the day so I removed the Nintex WF from the List (list WF). Essentially the WF was just an email notification that an item was awaiting there approval
I created a site Workflow to loop thru the list and send out a summary email for each approver listing the name of the document that requires there approval. In addition I provide a link to the Approve/Reject view. I have no plans on providing a link to the document itself within the email. Much to my horror I discovered after spending an hour on the workflow the loop only pulls in ID's for the Document Set not the Documents !
Questions
#1-How can I create a site workflow to determine if any document is pending approval
#2-How do I prevent someone from loading a document to the Top Folder. Some people are loading documents to the top folder and not within the document set.
